Taking the lowest bidder on asbestos abatement projects may
no longer be financially rewarding.
A new regulation to Industrial Code Rule 56 enforced by the New York State Department of Labor as of February 2006 adds a sub-section placing supervisory responsibility on General Contractors and/or Construction Managers for compliance of regulations.
All demolition, renovation, remodeling or repair projects involving asbestos remediation place responsibility for information all trades on the project site concerning presumable asbestos containing materials (PACM) and asbestos materials (known and assumed) on the General Contractors and/or Construction Managers. Moreover, as the "supervisor of the entire project, the general contractor or construction manager shall ascertain whether the asbestos contractor is in compliance" with said regulations.
Failure to perform the supervisory duties shall result in violations.
